Waiver and Release of Liability Agreement

Welcome to Uppity Pet Salon & Resort! Before we begin caring for your pet, we ask that you review and sign our Waiver and Release of Liability. This agreement outlines the risks associated with grooming, boarding, and other services, and confirms your understanding and acceptance of those risks.

By signing, you help ensure a safe experience for both your pet and our team. If you have any questions, feel free to reach out.

Please read carefully. This agreement includes a release of liability and waiver of legal rights and deprives you of the right to sue Uppity Pet Salon & Resort (referred to in this agreement as “Uppity Pet Salon & Resort”), and related parties. Do not sign this agreement unless you have read it in its entirety and understand its effect, policies, procedures, pet release, waiver of liability, assumption of risk, and indemnification agreements.

This Waiver and Release of Liability Agreement is entered into between Uppity Pet Salon & Resort and the pet owner for the services provided to the pet(s) identified above.

By signing this document, I, the undersigned, as the Owner of the pet(s) named above, hereby acknowledge and agree to the following terms and conditions:

1. Acknowledgment of Risks:

I understand and acknowledge that the services provided by Uppity Pet Salon & Resort may involve certain inherent risks, including but not limited to:

• Interaction with other pets, which may lead to accidents or injuries.

• Physical activities such as grooming, bathing, or exercise, which may cause injury, stress, or illness.

• Use of pet care products, which may cause allergic reactions or other adverse effects.

• Other risks that are commonly associated with the care and handling of animals in a professional setting.

I further acknowledge that the Resort takes all reasonable precautions to ensure the safety and well-being of my pet, but I understand that accidents, injuries, and illness can occur despite these precautions.

2. Release of Liability:

In consideration for the services provided, I hereby agree to release, waive, and hold harmless Uppity Pet Salon & Resort, its owners, employees, agents, and representatives, from any and all liability, claims, demands, damages, or actions that may arise from any injury, illness, loss, or damage to my pet(s), including but not limited to:

• Injuries or accidents caused by interactions with other pets or humans.

• Injury, illness, or death caused by grooming, bathing, or any other activity provided by the Resort.

• Any allergic reactions or adverse effects caused by the use of pet care products or treatments.

• Any losses or damages that may occur during the stay or transportation of my pet(s) to or from the Resort.

I understand that this waiver applies to any and all claims, whether arising from negligence or otherwise, and that I am voluntarily assuming all risks associated with the services provided.

3. Emergency Medical Care:

In the event of an emergency, I authorize Uppity Pet Salon & Resort to seek immediate veterinary care for my pet(s) if necessary, at my expense. I understand that every effort will be made to contact me immediately in the event of an emergency.

4. Full Payment for Services:

I agree to pay all charges for the services rendered by Uppity Pet Salon & Resort, including any veterinary costs or additional services that may arise due to an emergency or special care required for my pet(s). I understand that all fees are non-refundable.

5. Understanding and Agreement:

By signing below, I acknowledge that I have read and fully understand the terms of this Agreement. I understand that this Agreement is binding upon me, my heirs, legal representatives, and assigns. I affirm that I have voluntarily agreed to release Uppity Pet Salon & Resort from liability, as described above.

6. Consent to Use of Pet Photos:

I grant permission to Uppity Pet Salon & Resort to take and use photographs of my pet(s) for promotional, marketing, or social media purposes, including on the Resort’s website and social media pages. I understand that my pet’s name will not be disclosed without my permission.

7. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of laws principles. In the event of any dispute, the parties agree to resolve the matter through binding arbitration.

8. Signature and Date:

By signing this form, I confirm that I have read and understood this Waiver and Release of Liability Agreement. I voluntarily agree to its terms and acknowledge that I have had the opportunity to ask questions and seek clarification.
